A Fortune 100 medical supply company with over 300,000 products engaged Baker Tilly to review key contract terms and conditions in its government contracts (including both federal and state/local contracts) to assess its compliance systems, processes, resources and controls. The company was considering strategically re-organizing itself to expand in the government marketplace while effectively managing risk and limiting the impact to its broader commercial organization.
Baker Tilly's solution-driven approach
As part of this effort, Baker Tilly worked with the company’s outside counsel to review contract documentation, policies and procedures, transactional sales data, customer lists and product information to identify potential compliance high-risk areas.
Baker Tilly also conducted interviews with key legal, contracts and sales personnel and facilitated onsite meetings with stakeholders to better understand the documentation provided and the desired future state of the government business. Based on the information gathered, Baker Tilly identified gaps and provided observations related to systems, policies, processes and resources necessary to effectively comply with relevant regulations under different organizational structures.
The company ultimately decided to reorganize its government business based on this initial compliance assessment to facilitate its growth in the government marketplace.
The accomplished results
Under this new organization, Baker Tilly helped the company pursue and ultimately obtain a Federal Supply Schedule (FSS) contract while also establishing the pricing controls necessary to comply with FSS requirements.
Baker Tilly also delivered training to company employees outlining key compliance requirements and considerations associated with the FSS contract as well as other government contract vehicles.
Baker Tilly has assisted the company with its review of and responses to other government solicitations, some of which have involved discussing additional compliance requirements such as cost-reimbursable contracting, time and materials services contracting and labor law compliance.
Baker Tilly continues to support this company with a variety of services, ongoing compliance activities, the development of SOPs and general ad hoc support.
