Government contractors, at both the prime and subcontractor levels, face challenges in asserting the commerciality of their products. From structuring their offerings to drafting descriptions of their products or services, and from preparing price analyses to identifying comparable products in the commercial marketplace, contractors seeking commercial item determinations must navigate regulatory requirements that continue to evolve. This panel will discuss trends in the treatment of commercial products and services in U.S. government procurements and how contractors and subcontractors can prepare and document commercial item determinations that withstand government review.
